SECTION 5. CUSTOMS OPERATIONS INVOLVING THE PLACEMENT OF GOODS UNDER CUSTOMS PROCEDURES Chapter 25. << >> Chapter 27. C H A P T E R 26. "General provisions on customs operations involving the placement of goods under the customs procedure"
A r t i c l e 173.
The procedure of customs operations involving the placement of goods under the customs procedure
1. Customs operations involving the placement of goods under the customs procedure, performed in a manner and on terms determined by the customs legislation of the customs union.
2. The procedure and technology of customs operations involving the placement of goods under a customs procedure shall be established depending on the types of goods transported across the customs border, the type of transport used for such travel (road, air, rail, sea, river, etc.), categories of persons moving goods.
3. On behalf of the customs authorities of customs operations involving the placement of goods under the customs procedure, performed by customs officers, authorized the commission of such customs operations in accordance with their officers (functional) responsibilities.
4. Requirements of customs authorities in the performance of customs operations involving the placement of goods under the customs procedure must be justified and limited to the requirements needed to ensure compliance with customs laws and customs union.
5. Customs operations involving the placement of goods under customs procedures are applied equally regardless of their country of origin, departure and destination.
A r t i c l e 174.
Placement of goods under the customs procedure
1. Placement of goods under the customs procedure begins with the filing of customs authorities the customs declaration and (or) the documents required for placing goods under the customs procedure in the cases stipulated by this Code.
2. Goods subject to veterinary, phytosanitary and other forms of state control, may be placed under the customs procedure only after the implementation of appropriate controls.
3. Placement of goods under the customs procedure is completed the release of goods in accordance with the declared customs procedure.
A r t i c l e 175.
Place and time of customs operations involving the placement of goods under the customs procedure
1. Customs operations involving the placement of goods under the customs procedure, performed in the field of customs bodies and during their work.
2. Upon a motivated request of the declarant or customs representative individual customs operations involving the placement of goods under the customs procedure may be performed outside the location and working hours of customs authorities.
A r t i c l e 176.
Documents and information necessary for placing goods under the customs procedure
1. When placing goods under the customs procedure the person identified in this Code, shall submit to customs authorities the documents and information required for release of goods.
When carrying out customs operations involving the placement of goods under customs procedures, customs authorities may require submission of only the documents and information necessary to ensure compliance with customs laws and customs union representation which is stipulated by the customs legislation of the customs union.
2. The list of documents and information required for the release of goods, and the timing of their submission established by this Code.
3. Customs authorities may not refuse to accept the documents because of typographical errors, technical or grammatical errors that do not alter the data contained in the documents that influence the adoption of the customs authorities of the decision to release the goods.
4. Documents required for the release of goods, may be represented in the form of electronic documents in accordance with this Code.
5. Forms of customs documents shall be determined by the Commission of the customs union.
Customs documents filled in Russian, unless otherwise provided in accordance with this Code.
6. In accordance with international agreements of - members of the Customs Union and the international treaties of the - members of a customs union with other states to simplify and accelerate the release of goods may apply customs documents of other states, used for customs purposes.
A r t i c l e 177.
The presence of interested persons or their representatives when carrying out customs operations involving the placement of goods under a customs procedure
1. Interested persons or their representatives may attend the performance of customs operations involving the placement of goods under customs procedures.
2. At the request of the customs body of persons concerned or their representatives must be present at the performance of customs operations involving the placement of goods under customs procedures, in order to assist the customs authorities in their perpetration.
A r t i c l e 178.
The priority order of placing certain categories of goods under the customs procedure
Products needed for disaster response, emergency situations of natural and man-made military equipment needed to perform peacekeeping actions or exercises, as well as goods subject to rapid deterioration, live animals, radioactive materials, explosives, international mail origin, express cargo, humanitarian and technical assistance, communications and materials for the media and other such goods are placed under the customs procedure in a matter of priority.
